What your notice must include
To be effective, a DMCA notice must include all of the following:
- A physical or electronic signature of the copyright owner or an authorized representative.
- Identification of the copyrighted work claimed to be infringed (or a representative list, if multiple works).
- Identification of the material that is claimed to be infringing, with information reasonably sufficient to allow us to locate it — e.g., URL, page title, or order ID.
- Your name, address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.
Notices that do not include all of the above may be invalid under the DMCA. Knowingly making material misrepresentations in a DMCA notice can result in liability under 17 U.S.C. § 512(f).
Our response
On receipt of a valid notice, we may remove or disable access to the material, notify the affected user, and provide them a copy of the notice. Repeat infringers are subject to account termination in accordance with our Terms of Service §7 and §15.
Counter-notice
If you believe material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notice to the same address. A valid counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, phone number, and a statement that you consent to the jurisdiction of the federal court in the judicial district where your address is located (or, if outside the U.S., for any judicial district in which we may be found), and that you will accept service of process from the person who provided the original notice or their agent.
On receipt of a valid counter-notice we may restore the material as permitted by the DMCA, unless the original notifier files a court action.
